Report an Incident
If you are a JUA-insured midwife or birth center and an incident has occurred that may result in a claim, please notify us as soon as possible. Prompt reporting allows us to provide timely support and guidance to protect you, your practice, and your clients.

You should report any incident that might reasonably be expected to lead to a claim, such as the following:
Incidents
- Shoulder dystocia
- Medication administration errors
- Prolonged rupture of membranes
- Complications with meconium
- Placental abruption
- Retained placenta
- Unexpected complications, such as:
- unexpected breech delivery
- cord prolapse
- preterm or low birth weight baby
- maternal seizure
- Maternal shock
- Cord avulsion
- Any urgent/emergent transfer
- Transfer-related delays
- EMS-related issues
- IUD complications
- Unhappy client
Outcomes
- Antepartum or intrapartum fetal death
- Neonatal death
- Maternal death
- Birth injury, including:
- fracture
- neurological injury
- damage to tissue or organ
- disfigurement
- 3rd- or 4th-degree perineal tear
- NICU admission, with or without cooling
- Maternal blood transfusion
- Maternal ICU admission
- Poor prognosis for client or baby
- Request for participation in hospital debrief or Root Cause Analysis
- Notice of Dept of Health complaint or investigation
- Attorney correspondence, request for records
- Notice of claim or lawsuit
If you’re unsure whether to make a report, we encourage you to reach out. It’s always better to report early. There is no penalty for submitting a report that doesn’t result in a claim.
How to Report
To report an incident, please do the following:
- Download & complete the Incident Report Form:
- Upload the completed form to the JUA Program Administrator using this secure link:
- Then schedule a 30-minute call with the JUA Program Administrator to discuss the incident:
All reports are handled confidentially. Reporting does not mean a claim will be opened; it simply allows our team to support you proactively.
What Happens Next
After you report an incident:
- The JUA Program Administrator may ask you to upload the client’s full chart to the secure portal.
- The JUA Program Administrator will send your Incident Report, the chart, and any notes made during the phone call to our claims administrator, Intercare Insurance Services..
- Intercare will acknowledge receipt of your report and assign a claim number to it.
- A claims professional may follow up with you to gather more information.
- If appropriate, a claim file will be opened, and you will be assigned a claims representative and legal counsel.
- The JUA Program Administrator will remain available to support and guide you through the process.
Dos and Don’ts
- Make your report as soon as possible after the incident. It’s always better to report while everything is fresh in your memory.
- Do not discuss the case with anyone except the JUA Program Administrator, an attorney retained to represent you, protected peer review attendees, or your spouse. Discussing the case broadly raises the possibility of others being subpoenaed and/or conflicting information being circulated.
- Never alter a medical record after a claim has been made. This includes making additions, corrections, or deletions.
- Do not include any claims correspondence in the client’s medical record.
- Maintain copies of all claims correspondence in a secure location.
